Legal Question in DUI Law in New Hampshire

DWI conviction

I was convicted of DWI in NH, 2nd offense. BAC = .13. Sentenced to 3 days in county jail & 7 days in DWI program, loss of license for 3yrs. What can I do to get the 3 days suspended / waived? This will create hardship on family.

I seriously doubt you can do anything. It appears that these are mandatory minimum penalties. You may petition the court due to your circumstances, but dobut the judge can do anything to help.

If you were convicted, the jail sentence is mandatory by law. There is nothing you can do to avoid it unless you have some basis to vacate your conviction and get a re-trial. There are some instances when this is possible but it is rare.
