Legal Question in DUI Law in New Hampshire
Ex-Spouse Lost license for 2 years on First Offense DUI
My ex-husband lost his license for 2 years on a first offense DUI. Because NH does not support a work limited license this resulted in him losing his job...a good job that he had been in for 20 years. He was a field engineer and it required him to be mobile. Now - he is unable to provide child support or insure our son who was in the process of undergoing medical treatment. This really seems like an excessive use of power and unfair. I certainly don't condone driving under the influence but we all make mistakes. I know people that have recieved multiple offenses and haven't missed a beat. Is there any recourse? While I am angry at him, I'm more angry at the system for having so little consideration for those of us that were dependant on his ability to provide. His lawyer took the last of his savings to deliver that verdict....it just seams unreasonable.

You should consult with your divorce attorney. Generally, a conviction of a crime does not stop the order for child support or medical insurance. An arrearage may accumulate if he is not paying it as due. You should not let this matter remain idle. It should be brought to the attention of the divorce court so that appropriate steps can be taken.
I share your view that a two year loss of license seems harsh. However, I do not know the facts and circumstances of the conviction and can't comment further.
