Legal Question in Family Law in New Hampshire

Child support

I live in the state of NH and my exhusband is taking me back to court stating that his initial Counsel did not thoroughly explain all his options. Now in the permanent stipulation he has to pay child support for any of my children attending college and living with me, if they choose to live away he does not. What are my opitons and what can I do?

You did not indicate if your divorce was granted in the State of New Hampshire and when it was approved. These are critical items. There is a great deal of conccern about college funding and child support. The current state of the law is that the court can not order a parent to pay for college. Absent special circumstances, child support will cease generally upon age 18 or graduation fro high school. The answer to your question will depend upon when the divorce was granted and if it pre-dates the new laws. You will need to sit down with an attorney who can review all of the details and advise you of your options.
