Legal Question in Family Law in New Hampshire

Child support split payments?

I am divorced and according to the decree Primary residence of my three children is with my ex-wife, and support for my children is split basically 50/50.

However, My children reside with me 3 days a week (hour for hour). I will have it no other way save having them with me permanently. My issue revolves around the fact that I pay support to care for them for being with her 7 days a week yet pay for their additional support for the 3 days they are with me.

What can be done to remedy this situation?

In all honesty, if we are supporting them 50/50 like the decree says, shouldnt the almost half the week I am supporting them solo count for something?

Dont get me wrong, I will beg borrow, or steal to be sure I never miss a payment, but I can use some help to stay afloat.

Re: Child support split payments?

You did not indicate if the divorce was by agreement or after a trial in front of a judge. In order to determine what might be appropriate I would need to examine the decree and the financial affidavits. Generally the court will not modify the child support order unless either the parties agree, there is a substantial change in circumstances, or if there was fraud.

Each case has differences and the facts around yours may result in a different outcome. You should have a detailed review conducted by a local attorney.
