college loans

I have several loans taken out for my children's college and took these loans out but only under my name. Is my husband still held responsible for splitting these loans with me when we divorce even though the loans are in my name?

Under New Hampshire law, the starting point for a divorce is an "equitable division" off assets and liabilities. Depending upon the circumstances of the divorce and the financial position of each party, the court has wide discretion to deal with payment of this type of debt. Without more facts it is difficult to evaluate how a judge might allocate responsibility for these college debts.

As more facts are presented, a better answer is more likely.

These are likely considered "marital debt" if they are related to the marriage or incurred during the course of it. You should review the loans with your divorce attorney to determine the specifics.
