my niece is having trouble with her parents get along and soon or later if they dont come to agrement she wants to move out and live with me is that possible and could i have temp custdy of her.

Under Massachusetts law, guardianship is only awarded if the child's parents are "unfit." The age of your neice has some effect, but not as much as people believe.

It is impossible to answer on the limited information you provide. Depending upon the age of the child, the agreement of the parties and the living situation of all concerned there amy be some way to work this out. Clearly, cooperation and support among all involved would ease any legal proceedings. I would need much more information in order to advise you if there is a comfortable way to achive the goal you desire.
