Legal Question in Family Law in New Hampshire

Custody

My daughter 24 unmarried has a one year old child with a guy who now after a year is filing for custody. He does not pay child support and was originally ready to sign over all rights until his parents stepped in and agreed to get an atty for him and encouraged him to go for custody so he would not have to pay child support for years. My daughter cannot afford an atty however does not want the father to get custody. This child means everything to her and would be devastated if this guy manages to get custody. She also wants to move out of state to be near me her mother. Is there any chance for him to be able to get custody and can she move out of state with her son without any repercussion? I would appreciated any legal advice you could help us with. As her mother, my heart aches for her as she cries over the fear and stress of this whole situation. Thank you

There are many legal issues tangled up in your question. I urge that she get an attorney. If she is financially challenged, she may qualify for an attorney under the New Hampshire Bar Association, Pro Bono program. She should contact that office for assistance. If the case goes to court, each party will have a chance to convince the judge as to what would be in the best interest of the child. The judge may appoint a Guardian ad Litem to represent the child's best interests. An experienced attorney will likley know what needs to be said and how to present the case properly. Wihtout an attorney, your daughter would be fighting a more difficult battle.
