Legal Question in Family Law in New Hampshire
divorce law
my husband and I are seperated after 11 years of marriage. We both worked during the marriage, and he helped raise my 2 children, putting one through college. He makes 150,000 a year, I made 45-60,000 a year. He says I have no stake in the equity of our home because he made more than me, and he helped support my kids. I say regardless, I am entitled to half the equity in the house. Who is right? I am not asking for 1/2 of everything- just a car, which is paid for, and the home equity. Also, I am out of the house. If he pays the mortgage for a year before I file, am I not entitled to the equity?

You are entitled to marital equity. I recommend you speak with Attorney Laurie Hogan who practices in both NH and MA. 978.250.4255 ext 11.

New Hampshire is not a "community property" jurisdiction. You are not entitled to one-half. However, you are entitled, as is he, to "fair and equitable treatment." This means that the court looks at all the facts and circumstances to determine what is fair taking into account the contributions, both financial and otherwise, each of your have made to he marriage and the children.
It is best to consult with an attorney who can examine all of the facts pertient to your personal situation and help you achive what is a fair and just result.
