Legal Question in Family Law in New Hampshire

Divorce

I have been married for 18 years this June. My husband have two children together. This is the 4th time he has left me. 3 times for another woman, once which I can prove. We have a home which we refinanced 4 times adding 120,000 onto a second morg. to pay off mostly his debt. I have been going to school/working and do not make enough to pay the 2000/mo paymt. He says he will help. Problem he is not honest or reliable. He left because I would not refinance again for 40,000 more after doing so just 2 months ago. If he cannot pay bills with us together, how can he help with us apart. He sold a car we both owned last week and did not share the $. Stated he will, but legally the car was registered in his name so he owned it. The question, What am I entitled to. last year he made 62,000. I need 2000/mo from him to keep my house and utilities. He was paying the second morg. but is behind 2+ months. The kids will be with me full time. He will see them every other weekend. Can I get alimony? He also has retirement and what about social sec. benifits. We both want this to go as smooth as possible. But I don't want to loose my home for the kids. While I am in school I have 1200/mo for income which includes using student loan money.

Re: Divorce

You have presented a very interesting fact pattern. The answer is that you are entitled to fair and equitable treatment in the division of assets and liabilities. An attorney will need to perform an careful examination of all of the family assets and liablities in order to advise you more precisely.

Since it appears that both of you want to work in a cooprative fashion, you may wish to consider using Collaborative Law. It is a more modern approach to working together with the lawyers to resolve conflict and to craft a new relationship in dealing with your children and reducing conflict. www.collaborativelawnh.org

You situation deserves careful study and I urge that you retain an attorney.
