Legal Question in Family Law in New Hampshire
Divorce in NH
I have been living in NH for a year. My estranged wife moved from Boston to NH in October. We want to get a divorce - we have agreed on all terms including a joint child custody. I am ready to pay alimony as calculated and decided by the court if that is the way it works. Do we still need to be represented by attorneys? Can we get a divorce in NH or do we have to get it in MA? How much is the court fee going to be?

Re: Divorce in NH
So long as one of you has lived in NH for at least one year and the other party is willing to go forward with the divorce, there should be no problem filing in the New Hampshire court.
However, even though you have agreed, it is suggested that you should meet with an attorney to review the documents. There are many times where an error in division of assets now can have a substantial impact on your future welfare. The division of assets, retirement plans, savings, and bills, can lead to major conflict down the road.
Also, alimony may or may not be granted based upon all the facts and circumstances. Also, consider the tax impact of alimony in the overall divorce.
Court filing fees vary slightly, depending upon a few factors. It should be in the range of $200, not including Sheriff's fees if you go that route.
