DIVORCE-What are MY RIGHTS?

I met someone from overseas in 2004. He came to visit after a few meetings and stayed, we got married the end of 2005. He came with 10K and a suitcase and nothing else as he lost everything in his previous divorce. I had owned my home for 12 years with my ex. In my name only, purchased the home from my ex and gave him 80K as a down payment. Current husband is not on loan. I transferred a loan of his for 11K onto my credit card before we were married. It was his debt before we were married. He went thru all of his money as he didn't work for 8 months. I cashed in 20K of my IRA so we could survive. He is threathening me and saying he is entiltled to 1/2 and if I don't do things amicably he will get his own lawyer. He is only still a temp green card holder. What is the law regarding my personal property that was held before our marriage?

We racked up extra debt with taxes, etc and now owe 30K on one credit card. He seems to think that because he is not on the card he is not responsible? His income to mine the past 2 years was 1/3 of mine and I have assumed most of the bills as he has all these TOYS and I have been paying most of them. These are now all in his name only and he owes this himself now? HELP I need a lawyer

You have a rather complicated fact pattern which will require detailed review. I suggest that hiring an attorney would be beneficial.

As a general rule, the court has authority to divide assets acquired during the marriage and the same for debts. Items acquired prior to the marriage require individual study, and different results may arise depending upon all the circumstances existing between the parties.

The base line in New Hampshire is an equitable division of assets and liabilities. It is not necessarily an equal division. The court looks at all the facts and circumstances and determines what is fair and equitable.
