Legal Question in Family Law in New Hampshire

domestic violence order

My son's wife left Pineville, West Virginia on Sunday May 15, 2005 with thier two minor children and went to her father in New Hampshire. On Wed. 5-18-2005 she filed a domestic violence petition and a court date was set for 6-15-2005 in New Hampshire. She is not a resident of New Hampshire. Can she legally require my son to go to New Hampshire for a hearing? The allegations she has made are lies, and can be easily proven as such here where they resided. Is there no recourse to require the case be transferred to the state in which they lived and the incidents allegedly happened?

If your son's wife has established residence in NH, she is entitled to ask the court for a protective order (she can ask for one, she may not receive one).
