Legal Question in Family Law in New Hampshire

I would like my fiance to be able to adopt my two daughters. They are 12 and 10 years old and are very happy with hte idea of him adopting him. Their father has no contact with them nor does he wish to. I live in New Hampshire and he lives in Massachusetts. How would I go about to have this done?

There are a number of requirements necessary to achieve your goal. I would suggest that getting married is likely going to make the process significantly easier. The court is very reluctant to allow a fiance to adopt since there is no legal relationship between the two of you.

Next, the father of the children will need to sign forms releasing all of his parental rights. This will likely require that he consult with an attorney and that the attorney verify that he understands his rights and what is happening with his children.

Lastly, you and your (husband) fiance would file a petition for adoption including the consent of their father. The Court may also require that a guardian ad litem be appointed to represent the children to make sure that this action is in their best interest.

As you can see, the process requires a high degree of coordination and is often best accomplished with the assistance of attorneys.
