Legal Question in Family Law in New Hampshire
Can a foreign person be appointed as a guardian
Me and my wife are resident aliens in
US, and our minor son is born here.
We are preparing a will and (in case
we both die) we would to appoint my
sister-in-law as a legal guardian to
our son. She is a foreign national and
never even visited USA. Is that
possible, or we have to appoint a US
citizen/permanent resident instead.
We live in NH. Thank you.

You can appoint whomever you choose. If your sister in law became your son's guardian, she would still need to begin immigration paperwork to stay in the country with him.
