full custody wanted

i was served a stalking temporary protective order by my ex and he made up a bunch of stuff. i want full custody of our daughter, he wants full custody and wants to take her over state lines next fall. right now, i see her on friday, saturday, and sunday. how will this protective order effect my attempt to get full custody of our daughter. we were never married and we didn't have anything in writing until today when my ex was awarded temporary custody of our daughter. what can i do? what are my chances of getting full custody? thank you.

The answer to your question will require a comprehensive and detailed analysis of all of the facts and circumstances. "Custody" is no longer awarded in New Hampshire. The current term is "parenting rights and responsibilities." When the parties can not agree, it is customary for the court to appoint someone to represent the best interest of the child. This is called a Guardian ad Litem. The cost is usually shared by the parties. This person makes a recommendation to the judge as to what would be appropriate for the child. This is often a shared parenting plan.

I urge that you retain an attorney as soon as possible. This type of case can get out of hand very quickly and calm heads and focused energy are often the only way to avoid destroying relationships between parent and child.
