husband driving under the influence

my husband and i own a piece of property that my family has owned for 200 years. i want to know what my legal rights are before he has an accident while under the influence.should i attempt to buy him out so that his name is not on the deed.he has been in rehab before so i thought this was all behind us but he thinks he has it hidden from family but we all know.i need to make some decisions soon. thanks
