Legal Question in Family Law in New Hampshire

iminate divorce

if my wife and I divorce and she leaves the state, agrees to leave our children with me, do I have the right to have the house appraised and noted that she is no longer paying toward the mortgage, keep the house and maintain it, untill my youngest child is 18 (15 years from now) to sell. Then take the value of the house at the time of her departure vs. the amount owed and split that amount rather than the total profit?

Re: iminate divorce

So long as you both agree to this method of valuation and division of the marital homestead, your agreement will be accepted by the Court and enforceable in the future.

Under certain circumstances, a "change in circumstances" can result in the Court modifying divorce agreements but this should not be subject to modification.
