Legal Question in Family Law in New Hampshire
I am still married, however considering divorce. My husband and I have 3 small children, a house, and alot of debt. My mother in law and brother in law live in our home. I am concerned about what my rights are as far as he home is concerned, and am suspicious that my husband may use his mother to try and get full custody of the children and the home (I am a good mom and can't imagine any judge would find otherwise). Also, if I were to ask him and his mother to leave would I be within my right?

Your situation is rather complicated. There are marital rights between you and your husband, and potential landlord-tenant rights between the two of you and the rest of the family. As to the children, if you and your husband can not come to an agreement as to a parenting plan so that each of you get fair and reasonable time with the children, the court will appoint a Guardian at Litem (person who investigates what would be in the best interest of the children) to recommend a plan to the judge.
I suggest that you need to meet with an attorney as soon as practical to evaluate all of the options and plan an appropriate strategy to reduce conflict and resolve the matter so that both of you may find a comfortable level to be the best parents possible to your children, even though you are divorced.
