Mother's health

A friend lives in New Hampshire... Her mother is very depressed, and refuses to see the family doctor. Her youngest child dies last year, and she has become more and more depressed since then. She has begun to think her oldest son (now 15) is not well. He is fine. Her church has told her that grief is a lack of faith, and she will not grieve the loss ofthe child. My friend is very worried about her mom's mental state. What is the law on having your parent evaluated by a mental health professional without the parent's consent? My friend is 24 years old, and VERY worried.

There are some laws that may apply to the situation; however, they have some some significant hurdles that would need to be passed. One approach would be to try to show that she is incompetent and needs a guardian, not an easy burden to meet but it may warrant looking into. Another possible approach is to petition for an Involuntary Emergancy Admission at the New Hampshire State Hospital. The standard there would be whether her condition is such that she poses a risk to herself or others because of her mental condition. You may suggest to your friend that he or she threaten their mother with one or both of the above actions unless she voluntarily goes to see a mental health professional.
