Legal Question in Family Law in New Hampshire

Runaway Wife

My wife and I are not getting along and a divorce seems iminate. We have 2 children and, she has an interest in someone else who lives in N.C. I am concerned that she may leave and take my kids too. My question is, can she do this without my consent? Or is that a form of kidnapping? She says that she wouldn't do this, but in the next breath says she can't stay in our area, is there a way to keep her within the state?

Thank You

Re: Runaway Wife

Hi -

Once the divorce is underway, she'll be legally prohibited from leaving NH or the jurisdiction -

In the meantime, there is a recently-enacted state law which prevents her from taking the kids out of state w/out your consent.

My name is Len Foy - my office phone is (603) 434-3437 -

Regards & Good Luck -
