Legal Question in Family Law in New Hampshire

temporary custody duration

In Feb. 2002 my husband was granted temp. custody of our son. Shortly after the order we got back together and he never followed up on the permenant custody order. However, he claims that because he never got the temp. order changed, he still has legal physical custody of our son. He claims that if he leaves, our son will go to him. Is that true or has the order expired? If it hasnt how do I change it?

Re: temporary custody duration

Hello and Thanks for Your Inquiry:

My name is Len Foy and I am an attorney with Gould & Gould, we're located in Londonderry, New Hampshire. Our office telephone number is (603) 434-3437, and my email address is [email protected].

My guess is that the temporary orders have already expired. You can always call the court which issued the orders and check with the clerk. Otherwise, if you have the temporary orders you can fax them to me at (603) 437-8881 (Att'n: Len Foy) and I'll check with the court. It's a relatively simple matter.

If you'd like you can contact my office directly or send me an email.

Regards and Good Luck -

Len Foy
