Legal Question in Family Law in New Hampshire
Will they force my new husband to pay?
My ex has custody of our daughter. I am remarried. He is remarried. I have paid my child support since May 01 and am currently in arrears of $50.00. For the past year my x has prevented me or my family from contact with my child. Recently they moved without telling anyone. I managed to get the info from his parents. Now he has filed a Modification of Support and Contempt on me. I don't work but do odd jobs to make money to pay my support. My new husband works but his money goes to the everyday bills. We live paycheck to paycheck. I live in AZ and my x lives in NH therefore I can't go to this court hearing. I currently pay $200.00/mo in support (which is all I can afford). Can the courts order my husband to pay my support if they increase the amount? Also, Am I truely responsible for paying my x's lawyer fees? How do I fight this when I have no money and can't afford a lawyer or even to fly there to represent myself? My x says he won't let me see or speak to my child unless I'm supervised. Can he do that? I was told that I can't get a probono lawyer in NH cause I don't live there and can't get one here casue they go by my husbands income and he makes a bit too much. What can I do?

Hi -
My name is Len Foy and I am an attorney admitted to practice in California, New Hampshire and Massachusetts. My office is located in Londonderry NH.
I think your best bet is to try, as best you can, to retain an attorney in New Hampshire to represent you in the modification/contempt proceeding. If you'd like to discuss this matter, and also my fee for representing you at the court hearing, feel free to contact me at (603) 978-0421. Documents can be faxed to me at (603) 434-9578.
I hope to hear from you, and I wish you good luck -
