Legal Question in Civil Litigation in New Hampshire

How do you get money back for a defective product?

I bought a horse trailer in September from a lady in NH. She told me several things about it that I have found out to not be true. Including:

1) It is made out of galvanized steel – It’s not

2) It is safe for trailering horses – It’s not, the entire under-frame is rusted (wouldn’t happen if it was made out of galvanized steel)

3) It has FIVE BRAND NEW TIRES – none of the tires are brand new and they all need to be replaced.

Now I just want to return the trailer and get my money back. I am wondering what the best way to go about doing that is.

Thanks,

Kate

It depends on the value of the trailer where you might bring an action against the seller (small claims, state of federal court). But, what does the seller say about the issue? Maybe the seller will take it back or give you a partial discount? I would be happy to discuss this matter further if you would like to call me.
