Neighbors Development of Abuting Property
Is my neighbor legally obligated to minimize impact of construction on my right to use/enjoy my property? The development site directly abuts my back yard and construction dirt, debris & noise are intruding on our property including our pool. A chain link boundary fence owned by the neighbor divides the property but offers no privacy. The lot was previously heavily wooded. In addition, a tree along the boundary fence is arched over the property line and hangs directly above our storage shed. This tree was previously protected from falling by the other trees on the lot (now gone). If I have legal grounds to pursue a claim for damages what area of law would I consult? Our outdoor pool season is short and valuable to us and we are hoping that there is some recourse for our inconvenience.

It sounds like there is a possible claim for treaspass and or nuisance. You should consult a local land use lawyer in your town.
