Legal Question in Civil Litigation in New Hampshire

noisey condo renter

I own a condo below a man (who rents) and his three year old son. This man rents his condo from another owner in the same complex. My problem is that this man allows his son to run back and forth into the late night keeping me from sleep. I rise early so I retire early.

I have tried the diplomatic route by sending e-mail to the management company, the owner and I have spoken to the man himself, all to no avail.His latest response to me was that his son has to run and when I told him that if the problem did not stop I would avail myself of legal counsel. His response was ''good luck''.Do I have legal recourse??

Because he is a renter you may have recourse and against the renter and the owner. The noise could be considered nuisance or might violate the condo regulations. It is a tough call. The renter will just say you are sensitive and the kid is fine. At the very least document the times you are disturbed and keep putting the association, renter and owner on notice of the harm being done to you.
