Legal Question in Civil Litigation in New Hampshire

Responsibility of neighbor regarding vicious dogs

Family pet (15 yrs. old) attacked by neighbor's two Akita dogs, our pet had to be put down a few weeks later due to his being unable to walk normally or climb two steps to get in the house. Do we have any recourse to make sure this does not happen to someone else is family pet...

Thank you

Re: Responsibility of neighbor regarding vicious dogs

There is a NH statute directly addressing this:

"466:19 Liability of Owner or Keeper. Any person to whom or to whose property, including sheep, lambs, fowl, or other domestic creatures, damage may be occasioned by a dog not owned or kept by such person shall be entitled to recover damages from the person who owns, keeps, or possesses the dog, unless the damage was occasioned to a person who was engaged in the commission of a trespass or other tort. A parent or guardian shall be liable under this section if the owner or keeper of the dog is a minor."

The real question may be--what were your damages and how do you prove them?

Yes, Under NH law if you own a dog and it injures someone(including another dog) the owners are liable. Of course, could be some exception or defense that the dogs were mutually fighting and that your dog started it.

this should have been reported to the police and the town's dog officer. was it?

usually they would investigate and take remedial action.
