Marrying for a greencard

I have a friend who is planning on marrying a non-citizen wose vise is running out solely so he can stay in the United States. We, her friends, are desparately trying to talk her out of it. Can you list the repercussions to this kind of act? Also she has an 8 year old daughter we are worried about too. So we would like to know not only possible law breaking scenarios but also financial problems that could effect her and her daughter. Thank you.

Well, I believe the charge would "marriage fraud" and it would be prosecuted by the "Justice Dept." as a felony in U.S. District Court (federal court). There could also be perjury charges brought against her. The number of perjury charges would be based upon the number of times she stated under oath that the marriage was legitimate - at least 3 felony counts in my estimate. Have her call around to the lawyers in your area to see how much they would charge for representation for 4 federal felony counts. My guess is that if she got a quote of $10,000, it would be very reasonable. I wouldn't be shocked if it was as high as $50,000, but I don't handle criminal defense.

Then there is the cost of bail. It is not unusual to set bail at $25 - $50K, course you can pay a bondsman 10% and get released.

BTW, did you hear that Linda Tripp has a web site seeking donations to pay her legal fees? The only charge against her was illegally wiretapping Monica.
