Wrongful death

My 70 yr. old mother was killed in an auto accident caused by a plow truck. The driver of the plow was ticketed for failure to yield. The insurance company won't disclose policy limits, is there an easy way to find out what those limits are? And does it make sense to submit a policy limit request? Can you do that without a lawyer?

First, let me say that I am sorry for your loss.

Unfortunately, NH law does not require an auto insurer to disclose its policy limits on request. The only way to force them to do so is to file a lawsuit for the wrongful death claim against their insured driver, then request the policy information through the discovery process.

Whether or not it makes sense to make a demand for the policy limit depends on a lot of factors. The "value" of a case is not determined by how much insurace coverage there is, although that can often be a limiting factor in how much you can collect as a practical matter.

Wrongful death cases in NH can be quite complex, especially if there is arguably another driver (or others) involved. I really don't recommend that you try to resove this on your own. Hire an experienced trial lawyer who specializes in personal injury and death cases. This is not a case for "amateurs" or "Jack of all trades" types.

Simple answer is that you would be crazy to try to do a wrongful death claim without a lawyer.
