Legal Question in Landlord & Tenant Law in New Hampshire

Eviction process starting now, October, for a tenant 3 months behind on rent. There is a lease in place. Does NH have any law that will stop us from being able to evict them in winter months if they have children?

No. This is a very common misconception. If you don't pay your rent, you will be evicted, and eventually locked out by the Sherrif- kids or not, winter or not.

If you suspect you have any counterclaims, please, consult with an attorney WELL BEFORE your court date...ASAP. The security deposit law can sometimes provide that the landlord pays your attorney's fees- but not usually if you don't talk to a lawyer until after you've already been to Court! 90% of the people who contact us for Landlord Tenant help have already waited too long.
