Landlord Tenant NH

NH law states: The term Tenant or tenancy shall not apply to:Rooms in rooming or boarding houses which are rented to transient guests for fewer than 90 consecutive days.

I run a rooming house in which rooms are rented to transient guests...Do they automatically become a tenant after 90 days?

A very interesting question. I performed some brief research and came across a case at 146 N.H. 594; Johnson v. Wheeler. In that situation the occupant had been a resident in a rooming house for over two years. The court didn't directly address your question as it appeared that there was no disagreement that the occupant was a "tenant" and entitled to certain protections under the statute.

I think that your siutation deserves further examination and suggest that hiring an attorney to review your rental agreements and to develop a strategy would be beneficial.
