Legal Question in Landlord & Tenant Law in New Hampshire
NH - Landlord has tenant who needs to be evicted. Tenant is at will, but called code enforcement before landlord could evict. Tenant is being malicous to other tenants and really needs to go. Hasn't paid this months rent yet. How can lanlord evict tenant without it looking like retailiation for calling code enforcement?
1 Answer from Attorneys
The case is not driven by appearances, but by facts. Was the code violation allegation justified? Did the Code Enforcement Officer take any action? Was the rent current at the time of the report? All of these facts need to be explored in order that you might take appropriate action. Everything needs to be detailed.
You would likely benefit from meeting with an attorney to review all the facts in order that they might be examined in light of the statute, case law, and court rules.
