Writ of Possession

I was awarded an eviction judgement and tenant was given till 12/28 to appeal. On the award it states that a writ of possession will be issued if the tenant does not appeal or vacate. Do I need to contact the court to let them know the tenants are not out?

Yes. You will need a Writ of Possession and it must be served by the sheriff. There are procedures to be followed to physically remove the tenants and you must act appropriately. You may have obligations to protect the tenant's possessions during the process. In some courts it is preferable to file for contempt rather than taking physical action. Each case must be carefully evauated on its own merits. You may wish to consult with an attorney to review all the facts and circumstances of your case.
