Legal Question in Personal Injury in New Hampshire

car accident

i way hit by a 16 year old girl ,out of work for 10 mouths still have damage in foot and knee be like this rest of life . all i can get is what she has for inscurance or can i go after parents or some were else still need operation

what can i do

The 16-year old driver might have a second insurance policy you can reach, depending on the circumstances (for example, if she was driving someone else's car, or owned more than one car herself). If you or another household family member owned an insured car at the time, even if it was not involved in the accident, you may also have access to "Underinsured Motorist" coverage through that policy. Getting at the parents in order to get at another insurance policy, or perhaps the parents' assets, might be possible, but only under the right sets of circumstances. Obviously, with such serious injuries, you should not give up, or sign any settlement releases with anyone, until all possible avenues have been thoroughly checked out. There may be other sources of money for your injuries that you have not gone after. For example, if you or someone in your household had car insurance at the time of the accident, then "underinsured motorist" coverage may apply. (Your own insurer acts as if they provide more coverage for the other driver at fault.)

Also, depending on exactly what happened, other persons may have some share of the blame. For example, was she under the influence and if so, who seved her? Was it a borrowed car and how did she get it? Was the spot where the accident occurred poorly built or maintained and helped cause your injury?
