my son was hit by a car

My son, age 23 was hit by a car on Nov 2. He was not in a crosswalk and the car did not see him. He was taken by ambulance to a hospital, and suffered a scalp laceration/contusion requiring 2 staples, and a fractured T9 vertebrae, requiring a back brace and inability to work for 10 wks. He was on Short Term disability, at 2/3 pay, which wasn't much. Would the driver have any responsibility for medical bills, even though he was not in a crosswalk. There is a police case #. We are interested in med bills, and perhaps lost work payment?

When anyone is harmed by the fault of someone else, the victim has a right to receive money for the harm caused.

The first question is whether someone was indeed at fault. This takes a close examination of the facts by a trained eye. Even the police report does not answer this critical question.

The next question is what harm was caused. Of course out-of-pocket costs, like medical bills and lost wages, are included. But the bigger amounts are usually due to pain, physical limitations, worry, and perhaps life-long impacts.

The most important thing now is to get medical care. Use your own health insurance if you have it. Also, your own auto insurance probably provides some medical payments coverage. (All of this will be paid back by the person found liable for the crash.)

Next, get advice from someone looking out for your interests (not the insurer for the other guy). Most attorneys, including me, handle injury matters on a contingent fee. This means there is generally no cost to the client unless and until money is collected from the wrong-doer.

First, don't talk to the insurance company of the guy that hit your son.

Second, do whatever your doctor says and get better.

Third, go to a lawyer. Don't try to do that by yourself. It does not cost anything.
