Legal Question in Real Estate Law in New Hampshire

My association is considering selling a piece of jointly owned property with the intent that it should be used for residential construction. What terminology can we put in the proposal to indicate we do not want mobile homes on the property but something of higher quality? Our concern is that the construction could de-value the remainder of our association. Thanks!

Your question requires a lot more detail in order to offer a more substantive response. I expect that an attorney will need to review the association documents. What are the ownership rights of the associaiton? What exactly is "jointly owned?" What are the zoning restrictions for the parcel? Are the roads, water supply, septic system and other utilities adequate for the intended uses?

Also, if you are creating restrictive covenants as part of a conveyance you need to make sure they do not violate any other regulations or statutes. A conveyance of this type needs careful study so that any language can accomplish your goals and not be overly restrictive.
