Legal Question in Real Estate Law in New Hampshire
How many days to reply to offer?
I live in a house now and the owner has decided to sell it. The owner's lawyer contacted me by phone and gave me a offer to buy it from the owner. He also gave me a price in which the owner is asking. The lawyer claims I only have five days to respond to their offer. If he does not get a written response in five days from me the home I am living in will be put on the market.
Do I only have five days to respond to the offer or give them a counter offer? I feel that it would be longer than five days. The lawyer stated that he was being nice giving me five days and I also had to argue to with him get five business days and not just five days from today.
Any info would be great.

Unless you have some right of first refusaal, he has no obligation to offer it to you at all. You can agree to buy contingent on you getting financing if that is the issue with you. Requiring a response in 5 days is not unreasonable.

Hi -
I agree with the other attorney's opinion, there are no rules or regulations here - he could have just listed the property for sale or put an ad in the newspaper. Now, depending on whether you have a lease (and the wording of that lease, if it's still in force), any buyer of that property may buy it subject to your tenancy.
