Legal Question in Real Estate Law in New Hampshire

On the deed, but not on the mortgage

I own a home with my ex boyfriend as one-half undivided interest (tenants in common). The mortgage is in his name only. He has moved out and bought another home with another mortgage and wants me to pay him half the mortgage in rent since I am still living in the house we both own. What are my rights to stay since I own half of house and what am I obligated to pay? What are his rights to gain access since he still has keys and also owns half? We have been in the house 1 1/2 years only.

Re: On the deed, but not on the mortgage

You and your ex are business partners with property in common. If you can afford to buy him out, I recommend that you do that. if he is unwilling to sell, we can force the sale by court order.

Your ex is legally obligated to the bank/mortgage holder to pay the mortgage every month. If he defaults, you both lose.
