Legal Question in Real Estate Law in New Hampshire

I live in a very large single family home which has been crudely divided between two families. The head of the other family is the sole name on the mortgage for the property and has recently been sent to prison. He has no want to save the home from foreclosure but the rest of his family and my own family would like to save our home. Is there any chance of this happening? Also, I have third party authorization to speak to the mortgage company, but not to act on the mortgage payer's behalf.

This is a bit complicated. First, dividing a single family home into two separate spaces may violate local zoning laws. Caution needs to be exercised in this area. Second, the deed to the property needs to be examined. Which names are on the deed? Ownership of the house is an issue separate from the names on the mortgage. The underlying question is the desire and intent of the person who is in prison. If he is willing to cooperate there may be options available. The best way to explore the options is to meet with an attorney experienced in real estate matters and review the existing documents before talking with the bank.
