Legal Question in Real Estate Law in New Hampshire

Non-payment of real estate taxes

I own undeveloped land with my brother as tenants in common (by inheritance) since 1999. I have paid the real estate taxes in full each year, my brother has never paid, nor contributed to maintenance and management. I presume he's legally liable for past unpaid taxes. Is there a mechanism for me to acquire full ownership? Thank you.

You do not indicate the relationship between you and your brother. If he is willing to sign a deed transferring his ownership over to you, that should take care of your concerns. If not, you'll need to file a Petition to Partition with the court in order to have an equitable solution fashioned. You should consider hiring an attorney to help you with this situation.

Yes, you can force the issue by a Petition to Partition or perhaps Petition to Quiet Title. You could also just sue him for the money he owes but that will do nothing for future refusals to pay expenses.
