Partition for Sale
In 2003 my friend moved in with her boyfriend - in his house. Very soon after they refinanced with new mortgage and deed in both names. They essentially bought the house from him. The relationship has failed and she wants out, neither can afford to buy the other out. A ''Partition in Kind'' won't work and he wants to stay. Is a ''Partition for Sale'' the best solution. And what about time to complete.

Under New Hampshire law the action is called a "Petition to Partition." The statute addressing this type of action is RSA 547-C. The timeframe to complete this type of case depends upon the steps each party takes to protect their interest in the real estate. It would probably be worthwhile to meet with an attorney so that all of the facts and circumstance may be evaulated to determine if there are other, less expensive, options available.
