Legal Question in Real Estate Law in New Hampshire

personal property and security deposit

i was supposed to be moved completely by November 30, 2002 and as of today 12/16/2002 i am not. I was just informed that my past landlord got rid of my belongings with out notifying me first. He still has my security deposit and i was wondering if he can legally do that? He had enough money in the security deposit to let my belongings sit there until next week when i was going to pick it all up. The rent on the apartment was covered by the security deposit and yet he still got rid of everything.....please help...i have 4 children and their belongings were in that apt.

Re: personal property and security deposit

The statute gives the landlord the right to dispose of your items 3 days after you vacate. RSA 540-B:9.

The security deposit must be returned within 20-30 days depending upon whether you had a written lease.
