property disclosure form state of NH
Does the seller of a home have an obligation to disclose information about other homes in the neighborhood? In out town the DOT has temporarily taken ownership of 3 homes due to road construction. They are not being torn down, and will be resold at some point. They are currently rented out and occupied. Our realtor feels we do not have to disclose the fact that the homes are state owned and rented.

That sounds like rather an unusual situation. Assuming facts are true, I would think that if the road construction is planned to be nearby and is not evident from preparations, it would probably make sense to disclose the road construction plans. As to the houses, that is a different issue. The question is, how would they be any different from other houses being rented out? Perhaps there might be a slight decrease in house values if they were simultaneously marketed and the seller was under undue pressure to sell. I guess the real question is, why do you think they should be disclosed? You certainly can put the information on the disclosure form, if you feel it ought to be there.
