Property tax dispute on a newly constructed home
In my town, property taxes are paid from Apr 1 to Mar 31. I moved into a new construction home on May 20th. The town does now prorate taxes and billed me for the forst 6 months taxes for the period Apr 1 to Sept 30. I did not live in the home until May 20. The development company refuses to pay the portion of the taxes pertaining to the period Apr 1 to May 19th. They claim it was paid but the city has no record of any payment from them for the year 2004, only my first half payment. I would like to collect the prorated amount from the Development Company for the period Apr 1 to May 19. Do I have any legal merit to pursue legal action? The prorated amount is around $800.

Talk to the closing agent from the Bank, title company or the real estate agent if they tried to do closing. One of them is are responsible for prorating and if you had paid the taxes from April to September, you should have been credited with that on the RESPA statement.
