Legal Question in Real Estate Law in New Hampshire
quit claim deed
My mothers house was quit claim deeded to 5 siblings in 1993. In 2003 a living estate was drawn up naming one of the siblings as POA. Two of the other siblings are now living in the house. The POA is trying to evict one of the siblings from the house. Is this legal?

Re: quit claim deed
You have presented a very complex question which will require an examination of the documents you referenced. The Power of Attorney may have broad or limited powers and the rights of those in possession of the house may, or may not, be subject to the instructions of the Power of Attorney if there are ownership rights.
You need to meet with an attorney to review all of the documents and the facts surrounding this family situation in order to determine the options available to solve the problem.
