Legal Question in Real Estate Law in New Hampshire

How can I remove my ex wife from my home?

After my divorce, my ex wife was given possesion of our home with the agreement that I would buy it from her leter. Now after a long battle and a court hearing to have her ordered to sign the papers nessisary, I have finally done so. The funding went through this past week. At the hearing she was told she would have to be out by the first part of this month (November). However, she has now filed a motion to be allowed to remain in the house until spring. The papers she signed pertaining to the sale of the house specifically state that I as owner must immediately occupy the home or be in default. They also state that I must complete certain repairs to the house within 30 days of the funding or I lose a portion of the money included in the loan. I cannot even do this while she is there due to a restraining order against me. What can I do? The court date set for her motion isn't until next month and will be too late.

You need a lawyer. You must go to court and get an order from the court (writ of possession). The sheriff then goes to your place and tells her she must leave. If she does not he can literaly put her out on the street. As a practical matter, most people leave when the Sheriff calls or shows up at the door step.
