Replevin Case

I was taken to court through a replevlin case by my ex father in-law who wanted an above ground pool back after it being used in my yard for 7 years. I gave in because it was too expensive to fight and told him to come get the pool. The court paper work states the surrender of the pool will take place on the 1st Friday or Saturday after Sept 3rd 2007 by 5pm. Those dates have passed and the pool is still set up in my yard? Has he defaulted on his case? Do I have any rights to keep the pool now? Thank you.

It is difficult to provide an accurate answer without a review of all of the pleadings. You have not stated the reason for the delay. There are legal options available, but, as you noted, it will likely have an expense component to get a court to resolve this matter to your satisfaction.
