Legal Question in Real Estate Law in New Hampshire
we have a timeshare (in NH) that my wife inherited. My wife's deceased husband and previous wife were suppose to execute a quitclaim deed within 30 days of the divorce which never happened. Now we can't find the ex-wife and the property isn't worth enough to hire a PI and have all that done. Can we give up the property so we don't have to pay the annual maintenance fee? (The unit is completely paid for and we only are paying the annual fee, but we can't sell it or have it added to our exchange service)

In order to get clear title if you cannot find the previous wife, you might have to do a Petition to Quiet Title with notice by publication. It is a court procedure. However, even if you do this and get clear title then you are now fully responsible for the maintenance fees and as you have learned there is virtually no resale market for timeshares. In fact, you might find it difficult to even sell for $1.00.
