Title insurance

You have a home built by a custom builder. A title search is performed prior to closing. Title is clear and title insurance is purchased at time of closing. Now 6 months later a lien is placed on the house because the builder has not paid his sub-contractors. Is the homeowner liable?

at your closing there should have been a document signed by the seller that there were no subs that worked on the house in the previous 120 days that had not been paid; the sub contractor has a claim against the general contractor but it is secured against your house.
