Can I hold the employer responisble for a lead persons actions?

I walked out of a male-dominated workplace last week. It is a home builders occupation and I worked doing touch up to the houses before they were shipped. The lead roofer , since sept 02, when i started there, has made verbal sexual advances towards me. In December he put his hands down the front of my pants , later stuck his tongue in my mouth. I told co-worker, NOT A SUPER in fear of being forced out the door for the complaint.

The next incident was:back from x-mas break and he asked me 3x to watch him jerk off.

I then told a supervisor.

My co-worker told a Spervisor she was friends with about my situtaion, he told me he was going to management. The manager came to me a few hours later only to say (with this horrible degrading attitude) '' if i feel like i need to talk, I know where the office is, LATER''.

The supervisor that notified the manager told me a few minutes later that they were all having a good time laughing about it...

i have contacted a lawyer who has told me that I may not be able to hold the company responsible due to the fact that I assumed they werent going to do anything to him....

The answer is YES and HELL YES.

From what I have read this employee has a claim for sexual Harassment, assault and battery, hostile work environment, all in violation of Title VII of the 1964 Civil Rights Act and perhaps state and local civil rights statues.

She should also make a criminal complaint to the police on the assault and battery charges.
