Beneficiary
If something happens to me before I have a will in place who would be considered benificery my spouce or children?
If I have a trust fund and it states next or kin, is that spouce or child?

There is a statutory scheme to deal with these situations. The spouse gets a certain amount or percentage and your children geta portion if the statutory minimum spouse share is exceeded. I'm unsure what you mean by the phrase "trust fund," and suggest that sitting down with an attorney to prepare an appropriate will and supporting documents would help to resolve your concerns in an effective fashion.
